1. Scope
   1. These terms and conditions of participation apply to the participation in the competition organized by J.A.M.E.S GmbH, Willy-Messerschmitt-Straße 3, 82024 Taufkirchen (hereinafter referred to as "we").
   2. The terms and conditions of participation apply in the version valid at the time of use. By participating in the competition by submitting the entry form via the "J.A.M.E.S" -website at https://j-ames.com  (hereinafter referred to as the "Website"), you agree to these terms and conditions of participation.
   3. This competition is not affiliated with any social media provider (such as, e.g., LinkedIn, Facebook, Instagram, X, Reddit) and is in no way sponsored, endorsed, or organized by any of these providers.
2. Participation
   1. Any natural person over the age of 18 who is registered on the J.A.M.E.S platform at the time of participating in the competition may take part. Participation is free of charge and is not dependent on the purchase of goods or services.
   2. Each participant may only participate in their own name and only once per competition. Participation is only possible until the end date of the competition. The duration of the competition extends from February 3rd 2025 at 08:00 am (CET) to April 3rd at 23:59 (CET).
   3. To enter the competition, you must register with a personal account on the website and complete the entry form by providing your e-mail address.
   4. Employees and staff of J.A.M.E.S GmbH as well as their relatives are not authorised to take part in the competitions.
3. Procedure and Prize
   1. The winners will be determined by drawing lots either by us or by third parties commissioned by us. If the competition is linked to additional conditions, such as the submission of a solution word or similar, only participants who fulfil this condition will be considered in the draw. Any deviating, special selection procedures will be announced on the website. The winner(s) will be announced without guarantee.
   2. The winner(s) of the competition will be determined after the closing date of participation on a LIVE event in Microsoft Teams in a random raffle among all participants. Selected participants will be notified of their win by e-mail to the e-mail address provided during registration and requested to provide their name, address and date of birth and, if applicable, a telephone number where they can be contacted for any queries within two weeks of notification for the purpose of sending the prize. The participant is responsible for the accuracy of the contact details provided. Each participant notified in this way must also inform us within the aforementioned period whether he accepts the prize. If we do not receive such notification within the acceptance period, the possibility of accepting the prize will lapse, and we reserve the right to identify another participant and notify him accordingly. In this case, the originally determined participant shall not be entitled to any claims against us.
   3. The winner(s) may be announced in anonymized form on the website and/or the advertising media used by us, stating their first name and place of residence.
   4. Each participant can only win one prize per competition.
   5. The following prize(s) will be awarded:
      2 (two) gift cards. One gift card with an amount of 300 EUR for Apple and one gift card with an amount of 200 EUR for Samsung.
   6. The prize is limited to the scope specified for the respective competition.
   7. The prize cannot be exchanged, nor can the prize value be paid out in cash. Prizes are not transferable.
4. Premature Termination, Exclusion from the Competition
   1. We reserve the right to cancel, suspend or completely terminate the competition at any time without prior notice and without giving reasons. This applies in particular if the proper organization of the competition cannot be guaranteed for technical or legal reasons. In such a case, the participants are not entitled to any claims against us.
   2. Furthermore, we reserve the right to disqualify participants and exclude them from the competition. This applies in particular in the event of breaches of these terms and conditions of participation or if participants manipulate the competition or use other dishonest means or false or misleading information in connection with the participation in the competition. In such cases, prizes may also be subsequently cancelled and reclaimed.
5. Privacy
   1. Personal Data
      Participation in the competition requires the provision of a valid e-mail address. Beyond this, personal data will only be collected if it is voluntarily provided to us by the winner(s) notified in accordance with section 3.2 above. We use the participant data collected as part of the competition to organize and process the competition. The personal data collected as part of the competition will be passed on to the third parties commissioned by us to organize the competition (see section 3.1), insofar as this is necessary for the implementation and processing of the competition, in particular the dispatch of the prizes.
      You can request information about the personal data stored about you at any time, free of charge and without delay, using the contact details provided in section 5.2 below and, if necessary, request it to be corrected, blocked or deleted.

6. Liability
   1. We are released from all obligations upon delivery of the prize. We are not liable for legal and/or material defects. We accept no liability for the quality of the prizes.
   2. Except in the case of intent or gross negligence, we are not liable for damages that may arise due to errors, delays or interruptions in transmission, malfunctions of the website or other technical equipment, incorrect content, loss or deletion of data, viruses or in any other way during participation in the competition.
7. Miscellaneous
   1. Legal recourse is excluded.
   2. All incidental costs, taxes, duties or other costs incurred as a result of the prize, which we have not expressly advertised as being included in the prize, are to be borne by the respective winner.
   3. German law applies to the organization of the competition and these conditions of participation. If the participant is a consumer and has his habitual residence in another country at the time of participation, the application of mandatory legal provisions of this country remains unaffected by the choice of law made in sentence 1.
   4. These competition terms and conditions may be amended by us at any time without separate notification.
   5. Should any provision of these terms and conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these terms and conditions of participation. Instead of the invalid provision, the legally permissible provision shall apply which comes closest economically to the meaning and purpose expressed in the invalid provision. The same applies in the event of a loophole in these terms and conditions of participation.
